Importa Coffee ("Importa", "we", "us" or "our") operates the website importa-coffee.com and the related store, content, features, tools, products and services (collectively, the "Services"). Our store is powered by Shopify. This Privacy Policy describes how we collect, use, disclose and protect your personal information when you visit or use the Services, make a purchase, or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy governs the collection, processing and disclosure of your personal information.

Scope and Applicable Laws
This Privacy Policy applies to customers and visitors located in Canada and the United States. It is intended to meet the requirements of PIPEDA, applicable Canadian provincial privacy laws (including Quebec Law 25), Canada’s Anti-Spam Legislation (CASL), and applicable US state privacy laws, including the California Consumer Privacy Act (CCPA/CPRA) and the Florida Digital Bill of Rights, to the extent they apply to us.
Personal Information We Collect
"Personal information" means information that identifies you or can reasonably be linked to you. It does not include information that has been anonymized or de-identified so that it can no longer reasonably be linked to you. Depending on how you interact with the Services, we may collect:

Payment information, including payment card details, transaction details and payment confirmations. Payments are processed by Shopify and its payment processors; we do not store full card numbers

We do not intentionally collect sensitive personal information (such as health information or precise geolocation), and we ask that you do not send it to us.

Directly from you, when you create an account, place an order, subscribe, or contact us.

From our service providers, including Shopify, payment processors, shipping carriers and analytics providers acting on our behalf.

Why We Collect and Use Your Personal Information
We identify the purposes for which we collect personal information at or before the time of collection, and we limit collection to what is necessary for those purposes. We use personal information to:
Provide the Services. Process payments, fulfill and ship orders, manage returns and exchanges, maintain your account, remember your preferences and provide customer support. These uses are necessary to perform our contract with you.

How We Disclose Personal Information
We may disclose your personal information in the following circumstances:
With Shopify and service providers who perform services on our behalf (hosting, payment processing, data analytics, customer support, cloud storage, fulfillment and shipping). These providers are contractually required to protect your information and use it only for the services they provide to us.
With business and marketing partners to provide advertising services. These partners use your information in accordance with their own privacy notices.
When you direct or consent to the disclosure, for example to ship your order or when you use social media integrations.
With our affiliates or within our corporate group.
In connection with a business transaction (such as a merger or sale of assets), to comply with legal obligations, or to protect and defend our rights and those of our users.

Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. We also use certain Shopify enhanced features that rely on data from your interactions with our store, other merchants and Shopify. Cookies and Similar Technologies
We use cookies and similar technologies as described in our Cookie Policy, available at importa-coffee.com/cookie-policy. Non-essential cookies are set only with your consent, and you can change your choices at any time via the "Cookie Settings" link in the footer of the Site. Where required by law, we also honor the Global Privacy Control (GPC) signal as a valid opt-out of targeted advertising.
Children’s Privacy
The Services are not directed to children. We do not knowingly collect personal information from children under 13, and in Quebec we do not knowingly collect personal information from minors under 14 without the consent of a parent or guardian. If you are a parent or guardian and believe your child has provided us with personal information, please contact us so we can delete it. As of the date of this policy, we have no actual knowledge of selling or sharing the personal information of consumers under 16 years of age.
Security and Retention
We protect personal information with safeguards appropriate to its sensitivity, including encryption in transit, access controls and payment processing through PCI-DSS compliant providers. No security measure is perfect, and we cannot guarantee absolute security. We recommend that you do not share your account credentials and that you avoid sending sensitive information through unsecured channels.
We retain personal information only as long as necessary for the purposes described in this policy: while your account is active, for as long as needed to fulfill orders and manage returns and warranties, and for the periods required by law (for example, tax and accounting obligations, generally up to seven years). When personal information is no longer required, we securely destroy it or anonymize it.
Cross-Border Transfers
Our Services are operated from the United States. If you are located in Canada, your personal information will be transferred to, stored and processed in the United States and in other jurisdictions where our service providers operate, and may be accessible to courts, law enforcement and authorities in those jurisdictions in accordance with their laws.
If you reside in Quebec: your personal information may be communicated outside Quebec. Before doing so, we conduct the assessments required by Law 25 to ensure that it receives adequate protection, notably through contractual safeguards with our service providers.
Automated Decision-Making
We do not use your personal information to make decisions based exclusively on automated processing that produce legal or similarly significant effects on you. If this changes, we will inform you as required by applicable law.
Your Privacy Rights
Depending on where you live, you have some or all of the rights below. We will never discriminate against you for exercising them.

Access. Request access to the personal information we hold about you and information about how we use and disclose it.
Correction. Request that we correct inaccurate, incomplete or ambiguous personal information.
Withdrawal of consent. Withdraw your consent to the collection, use or disclosure of your personal information at any time, subject to legal or contractual restrictions.
Portability (Quebec). Receive computerized personal information you provided to us in a structured, commonly used technological format, or have it transferred to another organization.
De-indexation (Quebec). Request that we cease disseminating your personal information or de-index a hyperlink attached to your name where dissemination causes you injury or contravenes the law.
If you live in the United States (depending on your state):
Know and access. Request confirmation of processing and access to your personal information.
Delete. Request deletion of personal information we hold about you.
Correct. Request correction of inaccurate personal information.
Portability. Receive a copy of your personal information in a portable format.
Opt out. Opt out of targeted advertising, the "sale" or "sharing" of personal information, and certain profiling. Use the "Cookie Settings" link in the footer, enable the Global Privacy Control signal in your browser, or contact us.
Appeal. Appeal our decision if we decline to act on your request.
To exercise any of these rights, contact us using the details in Section 1. We may need to verify your identity before processing your request. You may designate an authorized agent to act on your behalf; we will require proof of authorization. We respond within the timelines required by applicable law (generally 30 days in Canada and 45 days under most US state laws, with extensions where permitted).
Marketing Communications
We send commercial electronic messages (email or SMS) only with your express consent, in accordance with CASL and the US CAN-SPAM Act and TCPA. Every marketing message includes an unsubscribe mechanism that takes effect promptly. If you opt out, we may still send you non-promotional messages, such as order confirmations and account notices.

We may update this Privacy Policy from time to time. We will post the revised version on this page, update the "Last updated" date and, where required by law, provide additional notice.
